Landlord vs tenant — default
Under both Missouri and Kansas landlord-tenant law, the landlord is responsible for maintaining the structural integrity of the rental property, which includes the exterior — roof, fascia, gutters, downspouts. Tenants are responsible for normal interior maintenance and reporting issues promptly.
Cleaning gray area
Most leases don't specify gutter cleaning. Default is landlord. Some leases explicitly assign cleaning to tenant — this is enforceable but uncommon.
If the landlord won't fix
- Submit written request via email or certified mail — creates paper trail
- If unaddressed for 14+ days and the issue affects habitability, you may have legal options
- Missouri: rental@hud.gov or local code enforcement
- Kansas: file with city housing department
- Small claims court is the last resort
