KS Claim Guide
Filing a Liberty Mutual gutter claim in Kansas
The state-specific timeline, depreciation rules, supplement process, and what to do when the adjuster lowballs you.
To file a Liberty Mutual gutter claim in Kansas: call (800) 290-8711 within 5 years of the storm date (KS statute of limitations). Get an independent contractor inspection BEFORE the adjuster arrives so you have your own Xactimate scope to compare.
The 5-step process
- Document the damage BEFORE you call anyone. Photos of every elevation, close-ups of dents/separation, date-stamped if possible. Storm date + hail size if known.
- Get an independent contractor inspection. Premier Gutters KC inspects free in 24-48 hrs and gives you a written Xactimate-style scope. This is your bargaining position.
- Call Liberty Mutual at (800) 290-8711. File the claim. Get a claim number. Note your adjuster's name + cell phone.
- Meet the adjuster on-site WITH your contractor. The adjuster will write their own Xactimate scope. Your contractor stands there with the independent scope and points out anything missed. This is where you win or lose the claim.
- Submit supplements within 30 days. When install begins and we find hidden damage (rotted fascia, bent hangers, damaged drip edge), we submit a written supplement to Liberty Mutual with photos. Kansas requires response within 30 days.
Kansas-specific rules
| Topic | Kansas rule |
|---|---|
| Statute of limitations | 5 years for written contract claims; 1 year for some bad-faith claims (K.S.A. §60-511). The clock typically starts on the date of the loss event. |
| Depreciation | Kansas allows ACV depreciation with RCV recovery. Depreciation rates vary by carrier; most use 4-5% per year on aluminum gutters. |
| Supplement timing | K.S.A. §40-2404 governs unfair claims practices. Supplements should be submitted in writing with photos and Xactimate scope changes. |
| Appraisal clause | Standard Kansas HO-3 policies include an appraisal clause. Either party may invoke it to resolve scope/cost disputes through binding appraisal. |
| Matching law | Kansas does NOT have a statewide matching law, but the Kansas Insurance Department has indicated that 'reasonable matching' is part of restoring the property to pre-loss condition. |

If your claim is denied or lowballed
You have three escalation paths in Kansas:
- Invoke the appraisal clause. This is binding and bypasses litigation. Each side picks an appraiser; a neutral umpire decides if they disagree. We can recommend appraisers who know gutter scope.
- File a complaint with the Kansas Department of Insurance. Kansas Insurance Department, Consumer Assistance: 1-800-432-2484. File complaints at insurance.kansas.gov. Carriers pay attention to DOI complaints because they trigger market-conduct review.
- Hire a public adjuster. Public adjusters work for YOU (not the insurer) on a contingency. Usually 10-15% of the claim. Best for claims over $10K.
